We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Payment of the price for the goods represents an offer on your part to purchase the goods, which will be accepted by us only when the goods are dispatched. Only at this point is a legally binding contract created between us.

To enable us to process your order, you will need to provide us with your email address and phone number. When you place an order we will email you to confirm receipt of your order and its details. You will then receive SMS messages and emails from our courier regarding delivery. For the avoidance of doubt, this correspondence does not constitute a contract between us.

All rights, including copyright, in this website are owned by or licensed to Orizaba Distribution Ltd. Any use of this website or its contents, including copying or storing it in whole or in part, other than for your own personal, non-commercial use, is prohibited without our permission. You may not modify, distribute or repost anything on this website for any purpose.

We have taken care in preparing the content of this website, in particular to ensure that prices are correct at the time of publishing and that all goods are described accurately. However, orders will only be processed if there are no material errors in the description of the goods or their prices as advertised on this website. Any weights, dimensions and capacities given for the goods are approximate only.

We try to ensure that this website is free from viruses and defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that you have suitable equipment to use the website. Except in the case of negligence on our part, we will not be liable to any person for any loss or damage to computer equipment arising from use of this website.

All orders are subject to acceptance and availability. If the goods you have ordered are not available from stock, we will contact you by email. You will have the option either to wait until the item is available or to cancel your order for a full refund.

You can correct errors in your order up until the point at which you submit it during the checkout process.

The prices payable for goods that you order are as set out on our website. All prices for UK orders include VAT at the current rate and are correct at the time of publishing. VAT on orders delivered outside the UK is charged as set out on our shipping page.

Where it is not possible to accept your order at the price shown, we will tell you by email and offer to sell you the goods at the correct price, stating how long that offer remains valid.

We take payment from your credit or debit card when you place your order. We accept no liability if a delivery is delayed because you did not give us the correct payment details. If we are unable to obtain full payment for the goods, we may refuse to process your order and/or suspend any further deliveries to you. This does not affect any other rights we may have.

Orders are placed online through our website and all prices are in pounds sterling. Card payments are processed securely by our payment provider and we accept all major credit and debit cards, including Visa and Mastercard. Payment can also be made by bank transfer, with bank details supplied on request. Goods will be dispatched once payment has cleared.

10.1 - Our delivery charges are shown at checkout and on our shipping page. Delivery charges vary according to the weight of the goods ordered and the delivery address.

10.2 - Delivery is charged in addition to the price of the goods, and it may not be possible for us to deliver to some locations.

10.3 - We will deliver the goods to the address you give us in your order, so it is important that this address is accurate. Please be precise about where you would like the goods left if you are out when we deliver. We cannot accept liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions, unless this is caused by our negligence. We will aim to deliver the goods by the date quoted, but delivery times are not guaranteed. In any event, we will deliver your goods within 30 days from the day after we receive your order. If delivery is delayed beyond this, we will contact you and either agree an alternative date with you or offer you a full refund.

10.4 - You will become the owner of the goods you have ordered when they have been delivered to you. Once the goods have been delivered they are held at your own risk and we will not be liable for their loss or destruction.

10.5 - Pallet Delivery - If you live in an area with narrow lanes or weight-restricted bridges, our haulage company may make an extra charge. Please let us know before ordering if your location is not suitable for a lorry.

10.6 - Safe Place Deliveries - If you will not be available to receive your delivery, you may ask us to have your order left in a place of your choosing and we will instruct the courier to do so. In this case you accept that Orizaba Distribution Ltd will not be liable for any loss, theft or damage once the item has been left. If you have any questions, please contact us.

If you order goods from our site for delivery outside the UK, they may be subject to import duties and taxes, which are levied when the delivery reaches its destination. Except where we have charged VAT at checkout, you are responsible for paying any such duties and taxes. We have no control over these charges and cannot predict their amount, so please contact your local customs office for further information before placing your order.

You must also comply with all applicable laws and regulations of the country to which the goods are being sent. We will not be liable for any breach by you of any such laws.

Risk of damage to or loss of the goods passes to you when they are delivered to you. You will own the goods once they have been delivered.

14.1 - Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 days of the day on which you receive your goods. You do not need to give a reason for cancelling. To cancel, please email us at support@briggsspares.co.uk with your order number.

This right does not apply to goods made or ordered specifically to your requirements, such as special order parts. Where a part cannot be cancelled or returned, this will be clearly stated in the product description.

14.2 - If you have already received the goods when you cancel, you must return them to us within 14 days of telling us you are cancelling. Unless the goods are faulty, you are responsible for the cost of returning them. If we have already dispatched the goods when you cancel, please do not unpack them when they arrive and return them to us as soon as possible.

14.3 - We will refund the price of the goods and the standard delivery charge within 14 days of receiving the goods back from you, or of you providing evidence that you have returned them, whichever is sooner. We may reduce the refund if the value of the goods has been reduced by handling beyond what is needed to check them.

15.1 - We reserve the right not to process your order if:

   15.1.1 - We have insufficient stock to deliver the goods you have ordered;

   15.1.2 - We do not deliver to your area; or

   15.1.3 - One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received from our suppliers.

15.2 - If we do not process your order for any of these reasons, we will tell you by email and refund any payment you have made in full within 14 days.

16.1 - If you do not receive the goods you ordered within 30 days of ordering and decide to cancel your order rather than arrange a new delivery date (in accordance with clause 10.3), we will give you a full refund.

16.2 - We are only responsible for losses that are a foreseeable consequence of our breach of these terms and conditions. We are not liable if we are prevented or delayed from meeting our obligations by anything you (or anyone acting on your behalf) do or fail to do, or by events beyond our reasonable control.

16.3 - We do not accept liability for any business losses, including but not limited to lost data, lost profits, lost revenue or business interruption.

16.4 - You must comply with all applicable regulations and legislation, including obtaining any customs, import or other permits needed to purchase goods from our site. The import or export of some of our goods may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

16.5 - Nothing in these terms and conditions limits your statutory rights as a consumer, or excludes or limits our liability for death or personal injury caused by our negligence. You have legal rights under the Consumer Rights Act 2015 in relation to goods that are faulty or not as described. Notices from us to you will be sent by email or displayed on our website.

We may change these terms and conditions from time to time. The terms that apply to your order are those shown on this page at the time you place it.

These terms and conditions and any contract formed under them are governed by English law. You may bring proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts of that country. All contracts are concluded in English.

If any part of these terms and conditions is found to be unenforceable, the rest of these terms and conditions will not be affected.

Nothing in these terms and conditions is intended to confer any rights on a third party.
